1. Introduction

Welcome to Duda Digital Media. These Terms of Service ("Terms") govern your use of our web design, hosting, and related services. By engaging our services, you agree to these Terms. Please read them carefully.

2. Domain Ownership

You own your domain. When we register a domain on your behalf, it is registered in your name. You maintain full ownership and control of your domain name. You will receive all necessary login credentials and can transfer your domain to another registrar at any time.

We act only as your agent in registering the domain. Domain registration fees are separate from our web design services and are subject to the policies of the domain registrar.

3. Hosting Policy

Your website will be hosted on our platform to ensure optimal performance, security, and support. Hosting is included in our monthly maintenance plan ($20/month).

Transfer Requests: If you wish to transfer your website to another hosting provider, please notify us in writing. We will accommodate reasonable transfer requests, though some technical limitations may apply depending on the platform architecture.

Your hosting includes SSL certificate, regular backups, security monitoring, and technical infrastructure maintenance.

4. Maintenance Plan

Our monthly maintenance plan ($20/month) includes:

  • Website hosting on secure, fast servers
  • SSL certificate for encrypted connections
  • Security monitoring and updates
  • Regular automated backups
  • Technical support via email

Content Updates: The maintenance plan covers hosting and technical infrastructure only. Content updates are billed separately:

  • Small updates (phone numbers, business hours, email addresses): $20 per request
  • Larger edits (new sections, service rewrites, image replacements, layout changes): $50 per request

5. Payment Terms

Website Design: The initial website design fee ($200 for a starter 3-5 page website) is due upon approval of the free preview. This is a one-time payment.

Maintenance Plan: Monthly maintenance fees ($20/month) are billed on a recurring monthly basis. Payment is due at the beginning of each billing cycle.

Update Requests: Invoices for content updates will be sent upon completion of work and are due within 7 days of receipt.

All payments are processed securely through our payment processor. Late payments may result in temporary suspension of services.

6. Cancellation Policy

You may cancel your monthly maintenance plan at any time by providing 30 days' written notice via email. There are no long-term contracts or cancellation fees.

Upon cancellation:

  • Your website will remain active for the remainder of your paid period (30 days from notice)
  • After the notice period, hosting and technical support will cease
  • You retain ownership of your domain and can point it elsewhere
  • Website files may be provided upon request, subject to technical limitations

Refunds: Since you receive a free preview before launch, the initial $200 website design fee is non-refundable once the website is approved and launched. Monthly maintenance fees are non-refundable but can be canceled for future billing cycles.

7. Support Boundaries

Our technical support includes assistance with:

  • Website hosting and technical infrastructure issues
  • Security concerns or SSL certificate problems
  • Domain configuration and DNS setup
  • Basic troubleshooting of website functionality

Support does not include:

  • Content updates (billed separately)
  • Training on third-party tools or services
  • Issues caused by third-party plugins or custom code not provided by us
  • Marketing, SEO consulting, or business strategy advice

Support is provided via email during business hours (Monday-Friday, 9am-6pm EST). We aim to respond to all support requests within 24 business hours.

8. Service Availability

We strive to maintain 99.9% uptime for all hosted websites. However, we cannot guarantee uninterrupted service due to factors beyond our control (internet outages, server maintenance, cyber attacks, etc.). We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the fullest extent permitted by law, Duda Digital Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Modified" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
